Risk-Based Surveys (RBS): Eligible Nursing Homes

On September 8, 2026, the Centers for Medicare & Medicaid Services (CMS) began a new Risk-Based Survey (RBS) process for nursing home inspections. Nursing homes that CMS deems “lower risk” now receive an abbreviated inspection: fewer survey activities, a smaller resident sample, and roughly half as much time onsite as a standard survey. CMS also marks these facilities with a gold trophy icon on Care Compare.
LTCCC opposes this policy. CMS selects facilities for RBS based largely on past survey results and quality metrics. These are not reliable indicators of a nursing home’s past quality and safety, nor reliable predictors of current or future care. Under the existing survey system, far too many violations are missed or under-coded, which inflates the very measures CMS uses to identify so-called “high performing” facilities.
Conditions in a nursing home can also change quickly due to changes in staffing, management, or ownership. Residents can suffer serious harm long before those changes show up in public data or ratings. LTCCC urges CMS to withdraw this policy and strengthen the survey system instead.
